Family Procedure Rule 5 – Use the Correct Form

The Family Procedure Rules provide that prescribed forms should be used for the cases to which they apply.

Documents that the form itself says must be attached should normally be attached unless the court directs otherwise.

Using the wrong form can:

  • delay an application
  • cause the application to be returned
  • lead to additional fees
  • mean important information is missing

Final Message

Family Court forms can look complicated, but the first question is usually simple:

What exactly are you asking the court to do?

Once that is clear, identify whether you are:

starting a new case, making an application in an existing case, enforcing an order, challenging a decision, seeking protection, dealing with finances, or responding to someone else's application.

Always read the form itself and its official notes before submitting it.

Right Form. Right Evidence. Right Procedure.

Right First Time UK

Important information: This page provides general information and signposting and is not individual legal advice. The detailed forms on this page primarily relate to the Family Court in England and Wales. Scotland and Northern Ireland have separate family-law forms and procedures. Not every form listed will be appropriate for an individual case. Some forms are highly specialist and are mainly used by local authorities, legal representatives, adoption agencies, international authorities or other professionals. A form should not be filed simply because its title appears relevant. Check the legal order, procedure and Family Procedure Rule that applies. Form C2 is normally the Part 18 application notice used during Children Act proceedings. Form D11 is normally used for relevant applications made during divorce, dissolution and financial-remedy proceedings. The current Family Procedure Rules list FM1 and FM5 in connection with non-court dispute resolution. Older references to FM2 should not be relied on without checking the current official rules. Form C1A should be used to provide relevant information concerning harm or domestic abuse in the children proceedings to which it applies. An allegation made in a court form is not automatically a judicial finding that the allegation is true. Form C8 protects contact information from disclosure to other parties but users must also avoid putting confidential details into other documents that will be served. Emergency and without-notice applications have additional legal requirements. Marking an application “urgent” does not guarantee an immediate hearing. Contempt proceedings are serious and should not be confused with ordinary enforcement of a Child Arrangements Order. Financial-remedy proceedings involve duties of full and frank financial disclosure. Appeals have strict procedural requirements and time limits. The correct appeal form depends on which court made the decision and which court will hear the appeal. Court fees, forms and procedural rules can change. Always obtain the newest form directly from GOV.UK, HMCTS or Justice.gov.uk before filing it. Last updated: 27 August 2026.
