Complaints, information rights and scrutiny

Choose the route matching the information, decision or remedy required.

Public transparency checklist

  1. Identify whether a county, district, unitary council, combined authority, NHS body, police force or another organisation owns the decision.
  2. Search committee papers, forward plans, delegated decisions and registers before submitting FOI.
  3. Save the report, meeting date, agenda item, decision-maker, vote and declared interests.
  4. Compare the approved budget with monitoring reports, final spending and measured outcomes.
  5. Search council contract registers, Contracts Finder and Find a Tender.
  6. For planning, retain the officer report, decision notice, conditions, obligations and appeal records.
  7. Use FOI for recorded public information, EIR for environmental information and SAR for personal data.
  8. Request an internal review where an FOI or EIR response is incomplete or inadequately reasoned.
  9. Complete the relevant complaint process before escalating to an Ombudsman unless a statutory appeal applies.
  10. Retain dated copies because online records and council structures can change.

EHCP accountability checklist

  1. Save proof of when the council received the EHC needs-assessment request.
  2. Track the six-week assessment decision and the overall statutory process.
  3. Request every education, health, psychology and social-care advice document.
  4. Ensure Section B records all needs and Section F specifies and quantifies provision.
  5. Check relevant health and social-care provision in Sections G and H.
  6. Respond in writing to the draft plan and state the preferred placement.
  7. Record every occasion when final-plan provision is not delivered.
  8. Use annual reviews to update needs, outcomes, provision and placement.
  9. Use tribunal rights for appealable decisions and complaints for delay or maladministration.
