The sections below add current GOV.UK, HMCTS, DWP and primary-law links to support the handbook.

MR

Mandatory Reconsideration Usually Comes First

For an appealable CMS payment decision, GOV.UK says you normally need to ask CMS for Mandatory Reconsideration before appealing to the Social Security and Child Support Tribunal. CMS says the MR request must normally be made within 30 days of the date on the decision letter.

SSCS2

Use Form SSCS2 for a Child Maintenance Appeal

HMCTS currently requires Child Maintenance appeals submitted by post to use Form SSCS2. GOV.UK specifically says Child Maintenance decisions cannot be appealed through the normal online appeal route.

Tribunal Appeal Deadline

GOV.UK says an appeal should normally be made within one month of receiving the Mandatory Reconsideration decision. If it is late, explain the delay; acceptance is not guaranteed.

Independent Tribunal & No Appeal Fee

The Social Security and Child Support Tribunal is supported by HMCTS and is independent of government. GOV.UK confirms there is no fee to make this type of appeal.

EVID

Evidence Can Be Added After the Appeal

After submission, HMCTS says the department that made the decision will send its response explaining why it made the decision, and you will receive a copy. You can then provide further evidence and statements to support the appeal.

HMCTS also allows an appeal-management account to track progress and upload evidence after registration.

DWP SAR: Obtain the CMS Records

DWP says a Subject Access Request can include your Child Maintenance Service account information, evidence used in a dispute or investigation, and other personal information held about you.

This is particularly useful when building a chronology, checking case notes, tracing payments or understanding the evidence CMS relied upon.

PAY

Direct Pay Records Matter

Current GOV.UK CMS payment guidance tells Direct Pay users to keep a record of payments. If a payment is disputed or missed, a bank statement may be needed.

Use clear references and preserve statements, standing-order records and transfer confirmations.

REP

You Can Have a Representative

HMCTS says anyone can be appointed as a representative, including a friend or family member. A representative can help prepare evidence, submit the appeal, advise you and act on your behalf.

ACCESS

Reasonable Adjustments & Hearing Support

HMCTS can provide reasonable adjustments for disabled tribunal users. Support may include accessible rooms, BSL interpretation, hearing equipment, large-print documents or breaks during a hearing.

RULES

Tribunal Procedure Rules

The Social Security and Child Support Tribunal operates under the Tribunal Procedure (First-tier Tribunal) (Social Entitlement Chamber) Rules 2008, as amended. The rules cover appeal procedure, hearings, evidence, case management and decisions.

LAW

Core Child Maintenance Legislation

The Child Support Act 1991 provides the primary statutory framework. The Child Support Maintenance Calculation Regulations 2012 contain key rules for modern CMS calculations, including income and calculation provisions.

If the First-tier Tribunal Gets the Law Wrong

If you disagree with the tribunal decision, GOV.UK says you may be able to ask for it to be set aside for a procedural problem or appeal to the Upper Tribunal where there is an error of law, such as failing to apply the law properly or give adequate reasons.

Suggested Tribunal Evidence Pack Structure

This is practical organisational guidance to make a complex CMS case easier to follow.

ADecision documents: CMS decision, MR request and Mandatory Reconsideration Notice.
BChronology: one concise timeline showing decisions, payments, changes and evidence submissions.
CGrounds of appeal: number each disputed issue and state exactly why the decision is said to be wrong.
DEvidence index: assign each document a reference and page number.
EReconciliation schedules: use tables for payments, arrears, income, shared care or pension issues where relevant.
FCMS response check: identify which parts of the DWP/CMS response you accept, dispute or say are unsupported.

Important: Do Not Redact Information the Tribunal Needs

Protect unrelated sensitive information where appropriate, but avoid removing dates, transaction references, account identifiers, payroll information or other details needed to verify the issue in dispute. If you are unsure what should be redacted, ask HMCTS or obtain advice before filing the document.

Important Pension Evidence Clarification

Pension treatment can depend on how contributions are made and how taxable income is recorded. Do not assume every pension contribution should simply be subtracted again from a payslip figure. Provide the payslip, pension statement and contribution history so CMS or the tribunal can see how the contribution was actually treated.

Important: Evidence “Weight” Is Case-Specific

The supplied handbook ranks some documents as stronger or weaker evidence. That is useful practical guidance, but a tribunal does not apply a fixed universal ranking. The weight given to a document depends on the issue, authenticity, context, consistency and the other evidence in the case.

CMS Tribunal Evidence & Accountability Handbook

A Practical Guide to Challenging Child Maintenance Decisions

Purpose

This guide is designed to help any parent involved with the Child Maintenance Service (CMS) prepare evidence, understand their rights, challenge errors, and present a clear and professional case before a tribunal.

It is particularly useful where disputes involve:

  • Incorrect arrears
  • Missing payments
  • Shared care disagreements
  • Income calculations
  • Pension contributions
  • Direct Pay disputes
  • Variations and diversion of income allegations
  • Failure by CMS to consider evidence
  • Procedural unfairness

1. Know Your Rights

Right to Reasons

You have the right to request:

  • A full explanation of a CMS decision.
  • Copies of calculations.
  • Evidence relied upon.
  • Notes of decision-making.

Relevant framework:

  • Child Support Act 1991
  • Child Support Maintenance Calculation Regulations 2012
  • Data Protection Act 2018
  • UK GDPR

Right to Mandatory Reconsideration

Before appealing to a tribunal you normally must request a Mandatory Reconsideration (MR).

The MR should identify:

  • Errors of fact
  • Errors of law
  • Missing evidence
  • Procedural unfairness

2. Understanding the Tribunal

The tribunal is independent of CMS and the Department for Work and Pensions.

Tribunal judges commonly focus on:

Evidence

Can the claim be proven?

Credibility

Are records consistent?

Documentation

Is there contemporaneous evidence?

Legal Basis

What regulation supports the argument?

Chronology

Can events be followed clearly?

Building a Tribunal Evidence Pack

Section 1 – Cover Page

Include:

  • Name
  • National Insurance number (partially redacted)
  • CMS case reference
  • Tribunal reference
  • Hearing date

Section 2 – Evidence Index

Example:

Section

Description

Pages

A

Chronology

1-10

B

Bank Statements

11-60

C

Payroll Records

61-90

D

Shared Care Evidence

91-130

E

Pension Contributions

131-145

F

CMS Correspondence

146-200

G

Arrears Audit

201-240

Section 3 – Chronology

Create a timeline.

Example:

Date

Event

Evidence

Date

Direct Pay started

CMS Letter B1

Date

Amount of payment made

Bank Statement C3

Date

CMS informed

Email D2

Date

CMS records arrears

Decision Letter E4

Date

Tribunals value chronologies because they simplify complex cases.

Bank Statement Preparation

Good Practice

Highlight:

  • Child maintenance payments
  • References used
  • Standing orders
  • Faster payments

Provide:

  • Original statement
  • Highlighted copy
  • Summary spreadsheet

Avoid:

  • Cropping statements
  • Editing transactions
  • Redacting relevant entries

Direct Pay Payment Tracing

Where CMS alleges missed payments:

Create a payment schedule.

Date

Amount

Bank Reference

Evidence

Then compare against CMS records.

Many disputes arise because:

  • Payments lack references
  • CMS records are incomplete
  • Historical records are missing

Shared Care Evidence Bundle

Useful evidence includes:

School Records

  • Collection logs
  • Attendance records
  • Parent communications

Medical Records

  • Appointment attendance
  • Registration information

Digital Evidence

  • Calendar records
  • Parenting apps
  • Travel bookings

Third-Party Evidence

  • Teachers
  • Childcare providers
  • Family support workers

Photographs

Useful only when dated and supported by other evidence.

Payroll Evidence

Include:

Payslips

Preferably 12 months.

P60

Demonstrates annual earnings.

P11D

Shows taxable benefits.

Employment Contract

Where relevant.

HMRC Records

Useful where CMS calculations differ.

Pension Contribution Evidence

Where pension contributions reduce assessable income:

Provide:

  • Pension statements
  • Employer confirmations

Payslips

  • Contribution history

Tribunals often consider:

  • Consistency of contributions
  • Retirement planning rationale
  • Whether contributions appear genuine

A long-standing pension pattern is generally stronger evidence than a sudden increase after a CMS dispute begins.

Arrears Audit Method

One of the most effective exercises.

Create a spreadsheet showing:

Month

CMS Expected

Paid

Difference

Then compare against:

  • CMS account statements
  • Bank statements
  • CMS decision letters

Common findings include:

  • Duplicate charges
  • Missing credits
  • Wrong effective dates
  • Incorrect shared care calculations

Cross-Referencing CMS Records

Create an evidence map.

Example:

CMS Claim

Your Evidence

Payment not received

Bank Statement B12

Shared care denied

School records D5

Income disputed

HMRC records E7

Arrears owed

Audit spreadsheet F3

This allows the tribunal to verify evidence quickly.

Evidence Standards

The tribunal generally considers:

Relevance

Does it prove the issue?

Reliability

Can it be independently verified?

Consistency

Does it match other evidence?

Weight

How persuasive is it?

Strongest evidence:

  • HMRC records
  • Bank statements
  • Official correspondence
  • Payroll records
  • Third-party records

Weaker evidence:

  • Unsupported statements
  • Screenshots without context
  • Undated documents

When CMS Appears to Ignore Evidence

Keep records of:

  • Evidence submitted
  • Dates submitted
  • Upload confirmations
  • Recorded delivery receipts
  • Telephone notes

Request:

  • Decision reasons
  • Case notes (subject access request if appropriate)
  • Mandatory reconsideration

A tribunal can consider evidence even where CMS previously gave it little weight.

Advanced Claimant Protection & Accountability

Where serious concerns arise:

Subject Access Request (SAR)

Request:

  • Case notes
  • Internal records
  • Decision logs
  • Contact records

Through:

Department for Work and Pensions SAR Information

Complaint Process

  • CMS Complaint
  • Independent Case Examiner (ICE)
  • Parliamentary and Health Service Ombudsman

Useful links:

CMS Complaints Process

Independent Case Examiner

  • Parliamentary and Health Service Ombudsman

Key Legislation & Regulations

Relevant legal framework includes:

  • Child Support Act 1991
  • Child Support Maintenance Calculation Regulations 2012
  • Data Protection Act 2018
  • UK General Data Protection Regulation
  • Department for Work and Pensions guidance and decision-making procedures.

Tribunal Judge's Checklist

Before the hearing ask yourself:

Have I produced a chronology?

Have I indexed every document?

Have I traced every payment?

Have I proved shared care with independent evidence?

Have I reconciled my figures against CMS figures?

Have I provided pension evidence?

Have I identified exactly where CMS may have made an error?

Can a stranger understand my case in 10 minutes?

If the answer is yes, your evidence pack is likely to be far more persuasive than a large bundle of unstructured documents. A well-indexed, cross-referenced bundle often carries more weight than hundreds of pages of evidence presented without explanation.
