How elective home education interacts with an EHCP and provision duties

A child can be electively home educated while an EHCP is maintained, but the effect on special educational provision should be understood before deregistration.

EHCP Can Continue

An EHCP does not automatically end because a child is electively home educated. It should continue to be reviewed while maintained.

Section 42

Responsibility can change.

Section 42 states that the local authority duty to secure specified special educational provision does not apply where the parent or young person has made suitable alternative arrangements.

Before Deregistering

Provision

  • Specialist teaching
  • Therapies
  • Equipment
  • Exam arrangements

Future

  • Annual reviews
  • Future placements
  • Return to school
