  • Relevant health and social care needs
  • Views and aspirations

Provision

  • Special educational provision
  • Relevant health and social care provision
  • Placement where applicable

Outcomes

Who Can Have an EHCP?

EHCPs may be maintained from birth up to age 25 where the statutory criteria are met. A diagnosis alone is not the legal test.

The focus is need and provision. The authority considers whether special educational provision may need to be made through an EHC plan.

Why the Final Plan Matters

Section 42 requires the local authority to secure the special educational provision specified in a maintained EHC plan, subject to the legislation.
