How mediation fits with EHCP disputes and SEND Tribunal appeals

In most cases a person considering a SEND Tribunal appeal must first contact a mediation adviser.

Before You Appeal

The decision letter should provide mediation details. You do not have to agree to mediate, but in many cases you still need a mediation certificate before appealing.

Section I Exception

Placement-only appeals are different.

You do not have to consider mediation if the appeal is only about which school or other institution should be attended.

Keep the Appeal Deadline in View

The mediation certificate affects the Tribunal deadline. Do not allow informal discussions to make you miss the appeal window.
